Article 1 - Definitions
In these terms and conditions the following terms shall have the following meanings:
Reflection period : the period within which the consumer can make use of his right of withdrawal;
Consumer : the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with Roger Trading BV;
Day : calendar day;
Duration transaction : a distance contract relating to a series of products and/or services, the supply and/or purchase obligation of which is spread over time;
Durable medium : any instrument that enables the consumer or Roger Trading BV to store information addressed personally to him in a way accessible for future consultation and unaltered reproduction of the stored information.
Right of withdrawal : the option for the consumer to cancel the distance contract within the cooling-off period;
Entrepreneur : Roger Trading BV
Distance contract : an agreement concluded between Roger Trading BV and the Consumer within the framework of a system organised by Roger Trading BV for the distance sale of products and/or services, whereby up to and including the conclusion of the agreement exclusive use is made of one or more techniques for distance communication;
Remote communication technology : means that can be used to conclude an agreement, without the consumer and Roger Trading BV being in the same room at the same time.

Article 3 - Applicability
- These general terms and conditions apply to every offer from Roger Trading BV and to every distance contract concluded between Roger Trading BV and the consumer.
- Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. This is done by publishing these general terms and conditions on the website where the distance contract is concluded.
- In the event that specific product or service conditions apply in addition to these general terms and conditions, the consumer will be informed of this and these specific product or service conditions will prevail.
Article 4 - The Offer
- If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
- The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable the consumer to properly assess the offer. Although all images are for illustrative purposes only and the delivered product may therefore differ from the images shown, Roger Trading BV will endeavor to publish a truthful representation of the products and/or services offered on its website. Obvious errors or mistakes in the offer are not binding on Roger Trading BV.
- Each offer contains sufficient information to clearly indicate to the consumer the rights and obligations associated with accepting the offer. This specifically concerns:
- the price including taxes;
- any costs of delivery;
- the manner in which the agreement will be concluded and the actions required for this;
- whether or not the right of withdrawal applies;
- the method of payment, delivery and execution of the agreement;
- the term for accepting the offer, or the term within which Roger Trading BV guarantees the price;
- whether the agreement is archived after it has been concluded, and if so, how it can be consulted by the consumer;
- the manner in which the consumer, before concluding the agreement, can check and, if necessary, correct the data provided by him in connection with the agreement;
- any other languages in which, in addition to Dutch, the agreement may be concluded;
Article 5 - The Agreement
- Subject to the provisions of paragraph 4, the agreement is concluded at the moment the consumer accepts the offer and meets the conditions set therein.
- If the consumer has accepted the offer electronically, Roger Trading BV will immediately confirm receipt of acceptance of the offer electronically. As long as Roger Trading BV has not confirmed receipt of this acceptance, the consumer may cancel the agreement.
- If the agreement is concluded electronically, Roger Trading BV will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment. If the consumer can pay electronically, Roger Trading BV will implement appropriate security measures.
- Roger Trading BV may, within legal frameworks, investigate whether the consumer can meet their payment obligations, as well as all facts and factors relevant to responsibly entering into the distance contract. If, based on this investigation, Roger Trading BV has good reason not to enter into the contract, it is entitled to refuse an order or request with reasons or to impose special conditions on its execution.
- Roger Trading BV has published the following information on its website relating to the product or service offered to consumers. Consumers should be aware of this before entering into the agreement:
- the visiting address of the Roger Trading BV branch where consumers can go with complaints;
- the conditions under which and the manner in which the consumer can exercise the right of withdrawal; for products to which the right of withdrawal does not apply, this is clearly stated;
- the information about warranties and existing after-sales service;
- the data included in Article 4, paragraph 3 of these terms and conditions;
- the requirements for terminating the agreement if the agreement has a duration of more than one year or is of indefinite duration.
- In the case of a long-term transaction, the provision in the previous paragraph only applies to the first delivery.
Article 6 - Right of withdrawal
Upon delivery of products:
- When purchasing products, consumers have the right to cancel the agreement without giving reasons within 14 days. This cooling-off period begins on the day the product is received by the consumer or a representative of the consumer designated in advance by the consumer and made known to Roger Trading BV.
- During the cooling-off period, the consumer will handle the product and its packaging with care. They will only unpack the product to the extent necessary to assess whether they wish to keep it. If they exercise their right of withdrawal, they will return the product with all accessories supplied and – if reasonably possible – in its original condition and packaging to Roger Trading BV, in accordance with the reasonable and clear instructions provided by Roger Trading BV. Once the consumer has used the product, the right of withdrawal can no longer be exercised.
- When services are provided, the consumer has the option to cancel the contract without giving any reason for at least fourteen days, starting on the day the contract is concluded, if the service has not yet started.
- If the service has already commenced and the consumer still wishes to exercise the right of withdrawal, this is only possible if it is still reasonably possible to terminate the service at that time. In that case, the costs already incurred by Roger Trading BV up to the moment the consumer expresses the wish to terminate the agreement based on the right of withdrawal, as well as any unavoidable costs, will be borne by the consumer.
- In order to exercise his right of withdrawal, the consumer will follow the reasonable and clear instructions provided by Roger Trading BV with the offer and/or at the latest upon delivery.
- In addition to this article, the provisions of the Roger Trading BV website on the page outlining the returns policy apply, insofar as relevant with regard to the right of withdrawal.
Article 7 - Costs in case of revocation
- If the consumer exercises his right of withdrawal, the costs of return will be at his expense.
- If the consumer has paid an amount, Roger Trading BV will refund this amount as soon as possible, but no later than 30 days after the return or cancellation.
- The consumer may have benefited from free shipping on their order due to reaching the minimum order value for free delivery. In that case, after returning an item, the consumer may no longer be entitled to free shipping because the order value has fallen below the free delivery amount. In that case, the shipping costs incurred will be deducted from the return amount.
- Optional, and therefore avoidable, costs, including but not limited to insurance premiums for insured transportation, and payment method fees when free payment methods are also available, are non-refundable.
Article 8 - Exclusion of the right of withdrawal
- Roger Trading BV may exclude the consumer's right of withdrawal, subject to the provisions of paragraphs 2 and 3 of this article. The exclusion of the right of withdrawal applies only if Roger Trading BV has clearly stated this in the offer, or at least in good time before the agreement is concluded.
- Exclusion of the right of withdrawal is only possible for products:
- which have been created by Roger Trading BV in accordance with the consumer's specifications;
- that are clearly personal in nature;
- which by their nature cannot be returned;
- Exclusion of the right of withdrawal is only possible for services: the delivery of which has begun with the express consent of the consumer before the cooling-off period has expired;
- which are listed in article 4 of our return policy ;
- Since the right of withdrawal applies to distance purchases, it is therefore self-evidently and explicitly not applicable if the consumer collects the goods from Roger Trading's business location, as the consumer is then able to check whether the goods meet the offer made and their expectations.
Article 9 - The Price
Article 9 - The price
During the validity period stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes due to changes in VAT rates.
Notwithstanding the previous paragraph, Roger Trading BV may offer products or services with variable prices, the prices of which are subject to fluctuations in the financial market over which Roger Trading BV has no control. This subjection to fluctuations and the fact that any stated prices are target prices will be stated in the offer.
Price increases within 3 months after the conclusion of the agreement are only permitted if they are the result of statutory regulations or provisions.
Price increases from 3 months after the conclusion of the agreement are only permitted if Roger Trading BV has stipulated this and:
these are the result of statutory regulations or provisions; or
the consumer has the authority to cancel the agreement with effect from the day on which the price increase takes effect.
the prices stated in the offer of products or services include VAT.
Article 10 - Conformity and warranty
- Roger Trading BV guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the legal provisions and/or government regulations in force on the date the agreement is concluded.
- A warranty provided by the manufacturer or importer does not affect the statutory rights and claims that the consumer can assert against Roger Trading BV under the agreement.
- The warranty period for repairs carried out by Roger Trading BV is 14 days and only applies if the consumer has approved all work recommended by Roger Trading for the repair in question, including all parts to be replaced. The warranty, of course, only applies if the defect is the same. The warranty on the repair expires if the consumer, after Roger Trading has repaired the repaired item, has had it serviced by themselves or a third party.
- All warranty, complaint, and return handling is offered by Roger Trading BV as a carry-in service. This means the customer is responsible for the transport, and any associated costs, to Roger Trading BV's location of the goods or vehicle(s) on which the customer wishes to claim warranty or return due to a complaint or otherwise.
- Roger Trading BV provides a one-month warranty on used (second-hand) scooters, calculated from the date of delivery. This warranty applies only if the scooter is used under normal conditions and in accordance with the instructions. This warranty also stipulates that all complaints and warranty procedures will be handled in accordance with the carry-in service as described in clause 10.4 of these terms and conditions, with the customer responsible for transport and any costs to the Roger Trading BV location. The warranty on used scooters expires if the consumer, after delivery, has had the scooter serviced by themselves or a third party, in accordance with clause 10.3 of these terms and conditions.
Article 11 - Delivery and execution
- Roger Trading BV will exercise the utmost care when receiving and executing orders for products and when assessing requests for the provision of services.
- The delivery address is the address the consumer provided to Roger Trading BV. When placing an order, the consumer is responsible for ensuring the correct shipping address. To assist consumers with this, Roger Trading BV has integrated a tool into the checkout page that checks the address against postcode databases; however, no rights can be derived from this. The consumer remains responsible at all times for ensuring the correct address is provided. Packages lost or misplaced due to incorrect addressing will not be reimbursed, and Roger Trading BV is never liable for this.
- Subject to the provisions of Article 4 of these general terms and conditions, Roger Trading BV will fulfill accepted orders expeditiously, but no later than within 30 days, unless a longer delivery period has been agreed upon. If delivery is delayed, or if an order cannot be fulfilled or can only be partially fulfilled, the consumer has the right to terminate the agreement free of charge.
- In the event of termination in accordance with the previous paragraph, Roger Trading BV will refund the amount paid by the consumer as soon as possible, but no later than 30 days after termination.
- If delivery of an ordered product proves impossible, Roger Trading BV will endeavor to provide a replacement item. The fact that a replacement item is being delivered will be clearly and comprehensibly communicated at the time of delivery. The right of withdrawal cannot be excluded for replacement items.
- The risk of damage, loss, fire, theft, and water damage to products during shipping/transport, from the moment the order leaves the Roger Trading BV warehouse until the moment of delivery to the consumer or a pre-designated representative of the consumer made known to Roger Trading BV, rests with the consumer, unless expressly agreed otherwise.
- Roger Trading BV offers standard insurance with every order placed on its website, providing full coverage for the transport risks listed in Article 11, paragraph 6, at the applicable price surcharge, which is clearly stated in the offer. Consumers are, of course, not obligated to use this service.
- For the delivery of orders that the consumer places with Roger Trading, an external party such as DHL, PostNL, DPD, etc. will generally be used. The parties agree that a delivery notification from the external party engaged by Roger Trading for the delivery of the order, via the track & trace information that this party communicates via the internet, will serve as convincing and binding proof that the order has been delivered.
- If the consumer has purchased insurance as described in Article 11, paragraph 7, they must report any defects, damage, or shortages within 24 hours of receiving the order. This 24-hour period begins on the date and time of the delivery notification made by the third party delivering the order on behalf of Roger Trading, in accordance with Article 11, paragraph 8.
- Roger Trading BV reserves the right to refuse service to both consumers and businesses without liability to the entity to whom service was refused or any other party.
Article 12 - Payment
Article 13 - Complaints procedure
- Roger Trading BV has a sufficiently well-publicized complaints procedure and handles complaints in accordance with this complaints procedure.
- Complaints regarding the performance of the agreement must be submitted to Roger Trading BV in writing, fully and clearly described, within a reasonable time after the consumer has discovered the defects.
- Complaints submitted to Roger Trading BV will be answered within 14 days of receipt. If a complaint requires a foreseeably longer processing time, Roger Trading BV will respond within 14 days with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed response.
Article 14 - Additional or deviating provisions
Any additional or deviating provisions from these general terms and conditions must be recorded in writing and clearly communicated to the consumer via this website in such a way that they can be easily stored by the consumer on a durable data carrier.
Article 15 - Right of retention, set-off or assignment
- If Roger Trading BV has a due and payable claim against the consumer, it may exercise the right of retention on all the consumer's goods in its possession, for all amounts owed or to be owed to the consumer under the Agreement, plus extrajudicial costs. If the consumer has not paid all due and payable claims within 30 days, Roger Trading BV is free to dispose of the goods as it sees fit. The consumer never has the right of retention on goods belonging to Roger Trading BV.
- The consumer is not permitted to offset any claim of Roger Trading BV against him.
- The consumer is not permitted to transfer any right under the Agreement to a third party without the prior written consent of Roger Trading BV
Article 16 - Disputes
- Agreements between Roger Trading BV and the consumer to which these terms and conditions apply are governed exclusively by Dutch law, even if the consumer resides abroad.
- The Vienna Sales Convention does not apply.
Article 17 - Liability

Roger Trading supplies goods to consumers and businesses. The customer is ultimately responsible for this and is responsible for assessing, among other things, whether they can successfully assemble the purchased items, if applicable. The company is never liable for problems arising from or after the assembly of the purchased products. These include, but are not limited to:
- theft
- injury
- fire
- accidents
- fines
- In the event that Roger Trading BV needs to carry out repairs to a consumer's vehicle that require a Roger Trading BV employee to test drive the vehicle, Roger Trading BV is not liable for traffic fines related to non-compliant modifications to the vehicle, such as, but not limited to:
- non-regulatory lighting items on the vehicle
- excessive vehicle capacity (tuned vehicle), any speeding fines resulting from this will be borne by the consumer
Article 18 - Amendment of the general terms and conditions
Roger Trading BV may update or modify its General Terms and Conditions of Sale and Delivery at any time at its sole discretion. When we do so, we will also update the "Last Updated Date" at the top of this page. Therefore, please check this page regularly.
